February 28, 2012 In the first half hour, Richard Renner interviews attorney Stephen Bergstein of Chester, New York. The Second Circuit recently decided that Bergstein’s client, Jason Jackley, has the right to refuse to make a false statement. In another case, however, the DC Circuit disagreed. Bergstein gets into the nitty gritty of the Supreme Court's decision not to address the conflict between the Circuits on this issue, and what it means for whistleblowers trying to win their cases.
